1. Introduction
Spaces Operations, LLC and its affiliated entities (referred to herein as “Spaces”, “we”, “us”, “our”) recognizes the importance of privacy. We want you to feel confident interacting with us and using our services.
This Privacy Policy is to help you understand what information we collect about you and your company (if a corporate account for example), and in some cases the end user customers of your company; and why; what we do with the information; and how we share it. It also explains the choices available to you regarding any personal information we may collect and how you can access and update this information.
In referring to “you”, or “your” in this Privacy Policy, we are referring to you as the individual person accessing the Spaces services, and also – as and when it may be applicable for the specific parties accessing the Spaces services – to your company, and in some cases the end user customers of your company.
This Privacy Policy is effective as and from 11/20/20.
2. Scope of Privacy Policy
This Privacy Policy applies to the information we obtain through your use of our web site located at www.spacesusa.com or any social media sites maintained by us from time to time (together with any subdomains and other related pages, our “Site”). It also applies to the information we obtain through your access to and use of our telephone and/or text message services, or our mobile or other applications that you may download to your computer, mobile phone, tablet or other electronic device and together with our telephone support services, other help desk services and technology support services as may be applicable (collectively, the “Spaces Services”), or when you create an account with us, email us, call us, send us a message, complete any of our online or paper forms or otherwise interact with us.
Due to the primary nature of the Spaces Services, where parties can access parking related information and services, including without limitation in order to assess availability and costs of parking spaces, coordinate and manage access to any such parking spaces, as well as pre-book and process payments for such parking spaces, we also collect and process information that will include personal data of our users. In general, any personal data collected during such processes will be used in order to allow you to use or receive the benefit of the Spaces Services, to reply to your queries, to carry out marketing activities, to provide customer support and to carry out data analytics, all in order to ensure you have an optimized experience. Please note that telephone calls and other verbal interactions may be recorded for training purposes and other purposes as specified in this Privacy Policy, and text messages and other written communications may be saved, again for purposes as specified in this Privacy Policy.
BY USING OUR SITE OR ANY OF THE SPACES SERVICES YOU AGREE TO OUR TERMS OF USE AND THE TERMS OF THIS PRIVACY POLICY.
3. Information we collect
We collect information about you as you use, access or interact with our Site and the Spaces Services. Such information may be gathered directly by us or through the services of third parties. Different ways that we collect and use your information include:
SPACESpass™ touchless entry/exit/payment system
We collect information about you as you use the SPACESpass™ touchless entry/exit/payment system. With SPACESpass™, parkers can enter/exit parterning parking facilities and pay for parking using a telephone number and/or text message services, and/or by using the Spaces proprietary app and related technology. Such information may include for example contact information such as name and telephone number, vehicle information, geolocation information and billing information such as credit card details and billing address. Information collected may be for example by means of the text messages you receive from and send to Spaces from your smart phone or other mobile device, responses to payment instructions and information provided in connection with such responses, any interaction with our telephone support services, other help desk services and technology support services as may be applicable, and any other interactions whether verbal, written or by other means.
Account and profile information
We collect information about you as you register with us, whether it is a limited, single-use registration, or in order to establish an ongoing account, and when you create or modify your profile or other account information, or otherwise use, access or interact with the Spaces Services. Such information may include for example contact information such as name, email address, mailing address and telephone number, profile information such as username, vehicle information, geolocation information and preferences information such as notification and marketing preferences. We may also collect, or use the services of a third party such as a payment processing party to collect, billing information such as credit card details and billing address.
In some cases another user (such as a system administrator from your company in the case of a corporate account) may create an account on your behalf and may provide your information, including personal information (typically when your company requests that we provide Spaces Services for the benefit of a company’s staff).
You or the other user (a system administrator or other relevant party) may also give us permission to access your information from other services. For example, your information with us may be linked to your account with Google, Facebook, Microsoft Office 365 or other third party account, which may allow us to obtain information from such accounts (like your basic profile or contacts or calendar scheduling).
Device type
When you register or use our mobile application (the “App”), we collect device type and UUID, a unique identifier generated within the App, and store this information in log files. Such information may include for example device hardware model, operating system and version, software and file names and versions, preferred language, advertising identifiers, serial numbers, device motion information, Bluetooth, WiFi, and mobile network information. We use this information to provide you with the most up to date application and features, or to advertise or promote products and services to you.
Web logs and analytics
As is true with most web sites and services delivered over the internet, we gather certain information and store it in log files when you interact with our Site and use the Spaces Services. Often such information is recorded automatically as your browser or mobile device sends it whenever you visit our Site or otherwise use the Spaces Services. Information may include for example internet protocol (IP) addresses as well as browser type, internet service provider, URLs of referring/exit pages, operating system, date/time stamp, information you search for, locale and language preferences, identification number associated with your devices, your mobile carrier and system configuration information.
Different types of information may also depend upon whether you are using a Mac or PC, or an iPhone or Android phone, as well as the specific security settings you have implemented on such devices. For example, the iOS platform may alert you the first time our App wants permission to access certain types of data and will let you consent (or not consent) to that request, and Android devices may notify you of the permissions that our App seeks before you first use the App, and your use of the App constitutes your consent.
Tracking information is also collected and stored in log files as you navigate through the Site and use the Spaces Services, including, but not limited to the date and time services were provided to you, amounts charged, any relevant promotional codes or coupon codes, payment status and other purchase history, parking location time and duration history, and click tracking.
In addition, and subject to your opt-out preferences as further explained in this Privacy Policy, we collect analytics information when you interact with our Site or use the Spaces Services. This analytics information may include for example information about the feature and function of the Spaces Services being used, the associated license identifier and domain name, the username and IP address of the individual who is using the feature or function.
We may use third party advertising tools (including Google marketing and similar advertising tools). This means that information related to your web browsing behavior or use of our App may be collected while visiting our Site or otherwise accessing the Spaces Services, which later can be used by third-party vendors, including Google, for the purpose of showing Spaces advertising on sites across the internet which have been approved in the display network. You have the option to opt out of Google’s use of cookies by visiting the Google advertising opt-out page.
Google Adwords Conversion Tracking: Spaces may utilize Google Adwords Conversion tracking to help us collect general usage statistics on how many Site visitors or App users have clicked on our Google ads and made an enquiry or purchase with us. This may be tracked using cookies which do not contain any personally identifiable information and expire within 30 days. For more information or to opt out of this service, please refer to Google advertising policies and principles.
Geolocation data
We will collect your geo-location information from time to time as you use the Spaces Services, including by means of your mobile devices and/or our App, so that we can determine, for example, to which parking location we should send you. We may also derive your approximate location from your IP address. You may at any time no longer allow the App to use your location by turning this off at the device level; however in such case we will no longer be able to provide the Spaces Services to you.
Invitations to Spaces
If you choose to invite a party to use the Site or the Spaces Services by completing an online or hard copy form, you will need to provide the name and email address of such party. Spaces stores this information to track the results of the invitation referrals.
Cookies
To help us serve your needs better, we, and our third party partners such as advertising and analytics partners, use “cookies” to store and sometimes track user information. These cookies may be either “session” cookies (that last until you close your browser) or “persistent” cookies (that last until you or your browser delete them). A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive. Some of the cookies we use are associated with your account (including personal information about you such as the email address you gave us), and others are not.
A web site can use cookies to recognize repeat users or track web usage behavior and other activities. Cookies take up minimal room on your computer and cannot damage your computer’s files. Cookies work by assigning a number to the user that has no meaning outside of the assigning web site. Users of the Site or Spaces Services should be aware that non-personal information and data may be automatically collected by virtue of the standard operation of Spaces computer servers or through the use of cookies. If you do not want information to be collected through the use of cookies, your browser allows you to deny or accept the use of cookies. There may, however, be many features of the Spaces Services which require the use of cookies in order to provide for the delivery of information and services to you.
Users should be aware that Spaces cannot control the use of cookies (or the resulting information) by unrelated third parties. The use of third party cookies is not covered by our Privacy Policy. We do not have access to or control over these cookies.
Public forums
Our Site may offer publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used for any purpose by others who access them. We are not responsible for the personally identifiable or other information you choose to submit in these areas. To request removal of your personal information from our blogs or community forums, contact us at privacy@spacesusa.com in some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.
Information from other sources
We also obtain information from third parties and combine that with information we collect through our Site and the Spaces Services. For example, we may have access to certain information from a third party social media or authentication service if you interact with our Site or use the Spaces Services through the service or otherwise provide us with access to information from the service. Any access that we may have to such information from a third party social media or authentication service is in accordance with the authorization procedures determined by that service.
4. Use and disclosure of information
We use and disclose your information for the primary purpose for which you have provided the information and overall to provide the Spaces Services. Such primary purpose may include for example:
• To communicate with you including for example by telephone and/or text messages;
• To facilitate scheduling, manage your account, responding to your inquiries or providing other customer services and support;
• To communicate with parking facilities in order to provide services to you on our behalf;
• To provide for third party payment processing services to facilitate payment for the Spaces Services;
• To alert you about relevant payment information including for example past, current and upcoming charges, presenting billing history and performing internal finance processes;
• To understand and improve the Spaces Services by researching and analyzing your use of, or interest in, the Spaces Services or other products, services or content offered by others;
• To communicate with you by means, for example, of service and administrative emails or text messages to ensure the Spaces Services are working effectively;
• Subject to opt-in authorizations as may be required, and your opt-out preferences as well, to communicate with you regarding new potential product or services features, or other news about us or on topics we think would be of interest to you (without limiting the generality of the foregoing, we will not undertake any text messaging marketing campaign without providing for proper disclosures and authorizations).
In addition to the use and disclosure of information outlined above, we also use and disclose information in an aggregated and/or anonymized form which cannot reasonably be used to identify you, and for other purposes ancillary and consequential to the primary purpose of collection. To this end we may also use the services of agents, service providers or contractors. Such third party service providers may include for example parties that provide web site development, crash reporting and related services, application development, hosting, maintenance, back-up, storage, virtual (or cloud computing) infrastructure, payment processing, analysis, marketing, SMS and other alerting services, providing customer support, account administration and other services. These service providers may have access to or process your information for the purpose of providing those services for us.
We may also disclose information (including personal information) to a third party if (a) we believe that disclosure is reasonably necessary to comply with any applicable law, regulation, legal process or government request, (b) to enforce our agreements, policies and terms of service, (c) to protect the security or integrity of the Spaces Services, (d) to protect Spaces and its rights and properties, and those of our agents, customers and others, and to protect such parties and the public generally from harm or illegal activities, or (e) to respond to an emergency which we believe in good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person.
We may share or transfer your information, including your personal information, in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition, divestiture or dissolution of all or a portion of our business, including for purposes of investor presentations and general information. In the event of an insolvency, bankruptcy or receivership, personal information may also be transferred as a business asset.
5. Security of information
We use appropriate security measures to help protect the security of your personal data both online and offline, including by means of using encryption technology. These measures vary based on the sensitivity of the information that we collect, process and store and the current state of technology. We retain the personal data we collect for so long as reasonably necessary to fulfill the purposes for which the data was collected, to perform our contractual and legal obligations and for any applicable statute of limitations periods for the purposes of bringing or defending claims.
Please note however that no web site or internet transmission is completely secure. We cannot guarantee the security of our database, nor can we guarantee that information you supply won’t be intercepted while being transmitted over the internet. Any information you transmit to Spaces you do at your own risk and we cannot accept any liability for any loss or damage suffered by you as a result of any unauthorized access to or disclosure of information supplied by you.
We recommend that you take steps to protect against unauthorized access to your device and account. In furtherance of the foregoing, among other measures, we recommend that you use unique numbers, letters and special characters in any passwords you create and not disclose your passwords to anyone. If your password to your account with us has been compromised for any reason, you should immediately notify us and change your password.
6. Accuracy of personal information
We take reasonable steps to ensure that the information we collect is accurate and up to date at the time of collection. In order to keep your personal information accurate and up to date with respect to your account with us, you can log in to review and update your account information, including contact and billing information, via your account settings page.
In other circumstances outside of any account, or otherwise as needed in order to change or update the accuracy of our records, please contact us and we will take reasonable steps to amend the information.
7. Access
You may request access to, changes or deletions of, personal information that we hold about you by contacting us at privacy@spacesusa.com. Please note that even if you request that we delete data we have collected from you, we may still retain data collected from you in an aggregated or anonymized form that does not identify you. We will also not delete your data if we are legally required to retain it.
You may also ask us what we do with your personal data, or request restrictions on the processing of such information and can revoke your consent at any time. In addition, you may at any time lodge a complaint or ask for the deletion or transfer of your personal data.
8. Do-Not-Track Disclosure
Spaces does not currently respond to web browser-initiated Do-Not-Track signals.
9. Changes to Privacy Policy
We may update this Privacy Policy to reflect changes to our information practices. We encourage you to review this page periodically for the latest information on our privacy practices.
